The Missouri Court of Appeals Eastern District has affirmed a circuit court ruling granting summary judgment in favor of the Board of Curators of the University of Missouri in a defamation lawsuit brought by the former St. Louis Public Radio general manager, concluding that the university was protected by sovereign immunity and had not waived that protection through its insurance policies.

In an opinion filed May 26, the appellate court upheld the decision of the Circuit Court of the City of St. Louis, which had dismissed Tim Eby’s claims against the university following allegations that St. Louis Public Radio, known as KWMU, republished defamatory statements about him after his removal from the station in September 2020.
