Butte district court judge to make ruling on data center initiative lawsuit

BUTTE, Mont. -- A ballot initiative to put the idea of building a data center in Butte up to a vote, which had collected the necessary signatures to appear in the November elections, may not appear on the ballot after all.

The coalition behind the initiative, 406 People First, filed suit against the city-county of Butte-Silver Bow, after the County Clerk & Recorder nullified their petition over a discrepancy in the signature collection deadline. Following a temporary restraining order granted by District Court Judge Frank Joseph, the case was heard via show cause hearing on Wednesday.
