The mother and estate of a 13-year-old boy who died after being injured on a carnival ride in Butte in June sued Butte-Silver Bow, the owner of the ride and its inspector alleging their negligence caused the boy’s death.

In particular, the suit alleges there were at least 10 chairs on the Yo-Yo ride, a carnival ride in which passengers dangle on suspended seats from a spinning structure, that did not have a restraint system in place, and that either the lack of or failure of a restraint system on the chair the boy was in caused him to fall or be thrown from the ride.
