The family of a University of Missouri student found dead on a trip with his fraternity had their wrongful death case dismissed Tuesday by a 13th Circuit Judge, according to court documents.Â
Riley Strain's family filed the lawsuit after he went missing and was later found dead in the Cumberland river in Nashville, Tennessee in March 2024, according to previous KOMU 8 reporting.
The family originally filed the wrongful death suit against multiple parties, including Delta Chi Fraternity, Inc. and 30 members of the fraternity, according to court documents.
The court ruled in favor of seven remaining defendants and the John and Jane Doe defendants in June, according to court records.
In December, 13th Circuit Presiding Commissioner Josh Devine ruled in favor of 18 fraternity members, along with the fraternity itself and the owner of the Delta Chi fraternity house in Columbia, according to previous KOMU 8 coverage.
"This resolves all claims in the matter," the court document reads.Â
Because the case was dismissed without prejudice, Strain's family can bring another lawsuit forward.
The claims were dismissed because of procedural reasons, because the court did not determine if the defendants were at fault.
Because those defendants had never been properly brought into the lawsuit, the plaintiffs' attorney asked the judge to dismiss those claims, and the judge granted that request.
Strain, 22, had his death ruled an accidental drowning. He was a senior at Mizzou.
Medical examiners discovered Strain's blood alcohol content was nearly three times the legal driving limit at Tennessee when he died, according to previous KOMU 8 coverage.
KOMU 8 has reached out to Delta Chi Fraternity representatives, as well as both attorneys for the plaintiff and defense for comment and have not yet heard back.Â
