REFUGIO – A Refugio County grand jury indictment alleges Goliad Independent School District trustee and former Refugio police officer Daniel Lee San Miguel used or displayed a handgun during two alleged aggravated sexual assaults of a child, stalked the complainant for two months and requested sexual favors while acting as a police officer.
On Aug. 11, San Miguel, 54, was indicted on two counts of aggravated sexual assault of a child, stalking and official oppression. The indictment lists the alleged offenses as occurring between April 1 and May 31 in Refugio County.
San Miguel was rearrested Aug. 12 in Refugio County on a warrant stemming from the indictment. He was arrested at 10:30 a.m. and booked into the Refugio County Jail at 10:43 a.m., according to jail records. He was released later that day.
The two aggravated sexual assault charges are first-degree felonies, stalking is a third-degree felony and official oppression is a Class A misdemeanor.
According to court records obtained by the Refugio County Press, the first aggravated sexual assault allegedly occurred on or about April 1 and involved a complainant identified only by a pseudonym “CV1” because the person is younger than 17. The indictment alleges San Miguel used or exhibited a deadly weapon, specifically a handgun, during the alleged assault.
A second aggravated sexual assault allegedly occurred on or about May 1. The indictment again alleges San Miguel used or exhibited a handgun during the incident.
The stalking count alleges that from approximately April 1 through May 31, San Miguel repeatedly followed the complainant to locations around Refugio. Prosecutors allege the conduct caused the complainant to feel harassed, annoyed, alarmed, abused, tormented, embarrassed or offended.
The official oppression count alleges San Miguel subjected the complainant to sexual harassment by requesting sexual favors while acting “under color of his employment as a public servant,” specifically as a peace officer employed by the Refugio Police Department. The indictment alleges the requests were unwelcome and that submission was expressly or implicitly made a condition involving the complainant’s exercise or enjoyment of a right or privilege.
The indictment was returned as a true bill by a Refugio County grand jury on Aug. 11.
The first alleged aggravated sexual assault charge carried a $500,000 surety bond, according to San Miguel’s booking sheet.
The Aug. 12 arrest came about two months after San Miguel was initially arrested June 6 following an investigation by the Texas Rangers. At the time, authorities said he faced allegations of aggravated sexual assault of a child and official oppression.
San Miguel serves on the Goliad ISD Board of Trustees and previously worked as a police officer and school resource officer for the Refugio Police Department. His employment with the department was terminated June 2, four days before his initial arrest. He served as a Refugio ISD school resource officer from January to May of the 2025 school year.
Following San Miguel’s June arrest, Goliad ISD Superintendent Holly Lyon said the alleged conduct was unrelated to the district, its employees or students.
“While this matter involves an elected official who serves on the Board, the alleged conduct is not related to Goliad ISD operations, employees, or students,” Lyon said at the time.
Following the indictment and rearrest, Lyon said the district remains in consultation with legal counsel concerning San Miguel’s status as an elected trustee.
“The allegations being reported are extremely serious; however, the criminal proceedings are matters for law enforcement and the courts, and the district will not comment on the facts or merits of a pending criminal case,” Lyon said.
A criminal trespass notice issued by Goliad ISD on June 8 remains in effect.
The charges are allegations. San Miguel is presumed innocent unless proven guilty in court.
